Refund and Return Policy

ArtSeed values transparency and fairness for both collectors and artists. This Refund and Return Policy outlines the rights and obligations of buyers and artists in compliance with EU consumer law (Directive 2011/83/EU) and German Civil Code (BGB §§ 355–357).

1. Right of Withdrawal

Buyers located in the EU have the right to withdraw from a purchase within 14 days without giving any reason.

  • Start of Withdrawal Period: The withdrawal period begins the day the buyer or a third party (excluding the shipping provider) receives the artwork.

  • How to Withdraw: To exercise the right of withdrawal, buyers must send a clear written notice to ArtSeed via email at [insert email address] before the 14-day period expires. A standard withdrawal form is available upon request.

Exceptions to the Right of Withdrawal:

The right of withdrawal does not apply to:

  • Custom-made or personalized artworks (e.g. commissioned pieces).

  • Buyers acting in a business capacity (B2B transactions).

2. Return Process

If a buyer withdraws from a purchase:

  • The artwork must be returned directly to the artist within 14 days of the withdrawal notice.

  • The buyer is responsible for return shipping costs and transport risk, unless otherwise agreed in writing.

  • The artwork must be returned in its original condition and packaging.

ArtSeed and the artist reserve the right to deduct reasonable compensation for any damage, loss in value, or missing components resulting from improper handling.

3. Refunds

  • Once the returned artwork is received and confirmed by the artist, a full or partial refund will be processed within 14 days, using the original payment method.

  • Refunds may be withheld until the artwork has been received and inspected.

  • ArtSeed’s platform commission is non-refundable, unless otherwise required by law.

4. Damaged or Incorrect Deliveries

If an artwork arrives damaged or significantly different from the description:

  • The buyer must notify ArtSeed within 48 hours of delivery by email, including clear photos of the item and packaging.

  • ArtSeed will coordinate a resolution between the buyer and artist, which may include:

    • A refund

    • A repair

    • A replacement, if available

The artist is responsible for safe and professional packaging. If the damage is determined to result from improper packaging, the artist may be held liable.

5. Platform Responsibility and Disclaimer

ArtSeed is a curated marketplace that facilitates the sale of original artworks. The sales contract exists directly between the buyer and the artist. ArtSeed:

  • Does not take ownership of artworks at any point.

  • Acts as a communication and transaction facilitator.

  • Will support both parties in resolving disputes in good faith but is not liable for damages beyond the scope of this policy.
